Terms of Service
The terms under which you may use the HYWOS website, accounts and software.

1. Who we are
The provider is HYWOS, Von-Stauffenberg-Straße 66, 19061 Schwerin, Germany (“we”, “us”). These terms govern your use of the HYWOS website, account system and desktop software (“the Service”). Full company details are in our Impressum.
2. Accounts
You must provide accurate details when registering and keep your login credentials secure. You are responsible for activity under your account and must be at least 18 years old or a business. Notify us promptly if you suspect unauthorised use.
3. Plans and payment
- Free — evaluation use on your own machine, with the workspace and document limits shown on the pricing page. In return, the app and this website record usage data including your chat history — see section 5, our Privacy Policy and our Data Processing Agreement.
- Plus, Pro and Max — paid subscriptions for a single engineer with the usage allowances (HYWOS units) shown on the pricing page, billed monthly. The app records no usage data.
- Company — a team subscription with two seats included and a shared monthly usage allowance; additional seats and top-up packs can be added.
- Team On-Premise — a per-seat subscription for a shared installation on your own server, including setup and administration support.
- Enterprise Air-Gapped — individually agreed deployments for the highest security requirements, including custom integrations and support.
All prices are net of VAT; the applicable VAT is calculated and added at checkout. Current prices and features are shown on the pricing page and may change with reasonable notice; changes never affect a period already paid for. Subscriptions renew automatically at the then-current price until cancelled. Payments are handled by Stripe.
4. Licence and single computer
While your plan is active, we grant you a non-exclusive, non-transferable licence to use HYWOS for your own engineering work. Unless your plan says otherwise, each licence is for a single user and is bound to a single computer; to move it to another machine, contact support@hywos.com. You may not resell, sublicense, redistribute, or reverse-engineer the software except where the law or an open-source component licence expressly permits it.
5. The software runs locally
HYWOS runs on your machine and processes your documents locally; the AI model also runs locally, and your documents are never uploaded — on any plan. You are responsible for your data and for keeping your own backups. Activation and periodic licence checks (for example monthly) require an internet connection; between checks the app can keep working offline until your plan expires. One difference by plan: on every paid plan the software sends us no chat history, no activity data and no document content — only the licence check itself — whereas on the free plan your chat history and your actions in the software are transmitted and stored, as set out in our Privacy Policy and our Data Processing Agreement.
6. Acceptable use
You agree not to use the Service unlawfully, to infringe others' rights, or to disrupt or circumvent its technical protections or licensing. You remain responsible for reviewing any output before relying on it for engineering, safety or compliance decisions.
7. Cancellation, refunds and right of withdrawal
You may cancel a subscription at any time. Cancelling does not end the contract immediately; it stops the renewal: your access continues until the end of the period you have already paid for and is not renewed after that. Fees already paid are not refunded, in whole or pro rata, for the current period. In justified individual cases our support team may grant a refund as a gesture of goodwill; there is no entitlement to one. Your mandatory statutory rights remain unaffected, in particular the right of withdrawal below and your rights in the event of defects. Consumers in the EU have a statutory 14-day right of withdrawal for the initial purchase. Where you ask us to begin providing a paid digital service during the withdrawal period, you acknowledge that the right of withdrawal lapses once the service has been fully provided. 8. Availability and changes
We aim for a reliable service but do not guarantee uninterrupted availability; maintenance and updates may cause temporary interruptions. We may modify or discontinue features, giving reasonable notice of material changes that affect you.
9. Warranty and liability
The Service is provided with reasonable care but otherwise “as is”. We are liable without limitation for damages arising from injury to life, body or health, and where liability is mandatory (e.g. under the Product Liability Act) or caused by intent or gross negligence. For slight negligence we are liable only for breach of an essential contractual obligation (a duty whose fulfilment makes proper performance possible and on which you may rely), and then limited to the foreseeable, contract-typical damage. Any further liability is excluded.
10. Governing law and jurisdiction
These terms are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods, and subject to the mandatory consumer-protection rules of your country of residence. Where you are a merchant, the place of jurisdiction is Schwerin, Germany.
